Judge Blocks Construction in Beach Mouse Habitat

A federal judge has issued a preliminary injunction against condominium developers to prevent them from destroying habitat for the endangered Alabama beach mouse on the Fort Morgan Peninsula in Alabama. The judge blocked the construction until the case can be fully heard on the merits. Permits issued by the Fish and Wildlife Service were challenged by Earthjustice attorneys on behalf of the Sierra Club and Friends of the Earth. In the past 17 years, the service has issued ten permits that allow developers to kill or otherwise harm Alabama beach mice. The agency has never denied a permit to protect Alabama beaches or the habitat they provide for protected species.
