Summary:  The Moapa Band of Paiutes and environmental allies filed suit in federal court over the issue of air pollutants from the Reid Gardner coal-fired power plant located just a couple hundred yards from the homes of Moapa Paiute families.

"Cleanup of this old, dirty power plant is long overdue," said Suma Peesapati, the Earthjustice attorney handling the case. "What the EPA has proposed does not protect the neighboring community of the Moapa Paiutes or the iconic beauty of the Grand Canyon."

  Summary:  A coalition of local, regional and national environmental groups represented by Earthjustice filed suit against the National Park Service seeking to block the approval of a high-voltage power line which would run through parkland spanning Pennsylvania and New Jersey on either side of the Delaware River. The groups are concerned that the 190 foot tall power line towers will ruin views and keep coal-fired plants open by enabling them to sell power to East Coast customers.

"This decision by the Park Service will permanently scar the landscape and degrade the visitor experience in some of the most visited national parks in the country," said Hannah Chang, an attorney with Earthjustice.

  Summary:  The Environmental Protection Agency is delaying issuing new rules to regulate coal ash, the waste product left from burning coal in power plants. Critics say the agency is unlikely to act until after the elections. In the meantime Earthjustice continues to work to protect the public from toxins associate with coal ash.

Lisa Evans, a senior attorney for Earthjustice, said in a statement, “Lawsuits are changing corporate behavior, but that’s not a safety plan for the nation.”

  Summary:  Conservation groups have intervened to define the travel management strategy for Tahoe National Forest. The travel management plan was drawn up by the Forest Service and restricts access to trails illegally made by offroaders, many of which are harming streams and wildlife habitat.

“We already know that off-road vehicles destroy the vegetation, compact the soil, erode the stream beds and threaten the wildlife in sensitive areas of the Tahoe National Forest,” Christopher Hudak, an attorney for Earthjustice, said in a statement. “Now that the Forest Service has taken steps to reduce the damage, we want to make sure these basic protections remain in place.”
