Court Asked to Close Lobster Fishery to Protect Monk Seal in Hawaii

Greenpeace Foundation, Center for Biological Diversity, and Turtle Island Restoration Network, plaintiffs in a federal court lawsuit filed in January seeking to protect the critically endangered Hawaiian monk seal from the impacts of commercial fishing in the Northwestern Hawaiian Islands, have gone into court asking Judge Samuel P. King to issue a preliminary injunction preventing the commercial lobster fishery from opening this year.

Supreme Court Asked to Review Air Quality Standards Case

Earthjustice Legal Defense Fund, on behalf of the American Lung Association, today asked the U.S. Supreme Cout to review an appeals court decision issued last spring that found that Congress had violated the U.S. Constitution by delegating too much authority to the Environmental Protection Agency in its mandate to interpret and enforce the Clean Air Act. The cases were consolidated as (American Trucking Association v. U.S. EPA. The American Lung Association was an intervenor in the lower court cases.

The Environmental Protection Agency has petitioned for review as well.

Appeals Court Overturns Death Sentence for Yellowstone Wolves

A three-judge panel of the 10th Circuit Court of Appeals today overturned a district court ruling that the wolves reintroduced to Yellowstone and central Idaho by the U.S. Fish and Wildlife Service ("FWS") must be removed. Had the December 1997 ruling by Wyoming Judge William Downes not been reversed, the reintroduced wolves would have been put to death because of the so-called "poison pill" provision of the wolf regulations developed by FWS.

Environmental and Community Groups File Suit to Protect Clean Air in Sacramento

Sacramento community and environmental groups filed suit in Federal Court today against the U.S. Department of Transportation, the Sacramento Area Council of Governments, and the California Department of Transportation for illegally approving a long-term transportation plan that will increase violations of federal standards for smog.
