Motion for Summary Judgement EPA Air Toxics Standards

This is an action to compel Defendant Administrator of the U.S. Environmental
Protection Agency (“EPA”) to perform rulemakings mandated by the Clean Air Act to protect
human health and the environment from major industrial sources of highly toxic air pollution.
There is no genuine issue as to any material fact, and Plaintiffs are entitled to summary judgment
as a matter of law on the question of liability.
