Legal Document: Court Overturns Government Refusal to Protect Rare Coastal Marten

A federal judge overturns an April 2014 decision by the U.S. Fish and Wildlife Service denying endangered species protection to coastal martens. The court’s action is in response to a lawsuit filed by Earthjustice on behalf of the Center for Biological Diversity and Environmental Protection Information Center.

Memorandum Opinion Blueback herring ESA Listing

The Court will grant Plaintiffs’ motion for summary judgment and deny the Service’s cross-motion for summary judgment. The Court will, accordingly, vacate the Listing Decision with respect to blueback herring and will remand this matter to the Service for further proceedings consistent with this opinion.
