Getting It Right for the Arctic Ocean

Thanks to long-running Earthjustice litigation on behalf of Alaska Native and conservation groups, the Ninth Circuit Court of Appeals recently ordered the Department of the Interior to reconsider its decision to issue millions of acres of oil leases to companies like Shell and ConocoPhillips in the Chukchi Sea. In response, the government has suspended drilling there pending the review.

Towns Fight Back Against Fracking

In mid-December the Pennsylvania Supreme Court found Act 13 is unconstitutional. This is a law that allowed state government to override local communities’ zoning decisions to limit hydraulic fracturing or fracking. The decision stems from a lawsuit by seven Pennsylvania municipalities, a doctor and the Delaware Riverkeeper Network. Earthjustice submitted a friend-of-the-court brief in the case, representing 22 organizations, including Marcellus Protest, Lehigh Valley Gas Truth and Berks Gas Truth.

Controversial Repowering of the Cayuga and Dunkirk Coal-fired Power Plants

Earthjustice is representing the group of elected officials in the repowering proceedings before New York's Public Service Commission. At issue is a controversial, precedent-setting decision: whether to repower the uneconomic coal-burning Cayuga and Dunkirk power plants with natural gas—a plan that would lock the region into continued use of fossil fuels and hike electricity bills for people and businesses across a 20-county region in western and central New York, or take the plants offline and instead upgrade the transmission lines—a cleaner and far less expensive option.
