Industry groups sued to further weaken nationwide permits that already allowed excessive dredging and filling of streams and wetlands in many states.
Earthjustice intervened to oppose the industry challenge. In September 2006, a federal district court rejected industry’s challenge. Industry’s appeal from that ruling was dismissed by the D.C. Circuit in February 2008.
