We need your help to ensure the New York State Assembly does not hold up critical energy affordability and climate legislation and passes the NY HEAT Act this legislative session!  As the federal government eviscerates the laws that protect our health and environment, New York’s nation-leading climate law sets in place critical mandates to phase out  fossil fuel use and into a zero-emission future. The Trump administration may be trying to take the country back to an era with smog choking our cities and dirty air and water, but Earthjustice is fighting back and forging ahead by challenging their actions in the courts and supporting clean energy policies in states like New York to forge our clean energy future. One crucial policy is the NY HEAT Act, and we need your help to push this critical legislation forward.  

The Home Energy Affordable Transition Act, also known as the NY HEAT Act, will reduce the expnsion of New York’s outdated fracked gas system and save New Yorkers an average of $136 every month in their utility bills.  

On top of those crucial savings, the NY HEAT Act will also free New Yorkers from the “gas mandate” which is an archaic state law that locks utilities into the gas system for heat.  Because of the gas mandate, one home that wants to stay on the gas system can be the deciding factor for an entire neighborhood that would otherwise have the opportunity to receive cheaper, cleaner heating alternatives from their utility. This legislation is a crucial step forward in addressing the energy affordability crisis and electrifying our buildings.Every measure of the NY HEAT Act would save New Yorkers money on their energy bills, protect public health, and create good, clean energy jobs. The legislation would ensure there’s a plan to cap utility bills for low to moderate income households, eliminate needless fossil fuel subsidies, and bring the statewide gas distribution system into alignment with our landmark climate law. If this bill passes, New Yorkers that need it the most stand to save $136 per month!

Many of us may have never heard of the National Environmental Policy Act (NEPA) and the Administrative Procedure Act (APA), but laws like these require our government to ask the public to weigh in before agencies adopt or change regulations.

Regulations essentially describe how federal agencies will carry out laws — including decisions that could undermine science, or weaken safeguards on public health.

Public comments are collected at various points throughout the federal government’s rulemaking process, including when a regulation is proposed and finalized. (Learn about the rulemaking process.) These comments become part of the official, legal public record — the “Administrative Record.”

When the public responds with a huge outpouring of support for environmental protections, these individual messages collectively undercut politicians' attempts to claim otherwise.

What this means is each of us can take a role in shaping the rules our government creates — and ensuring those rules are fair and effective.
