The Clinton-era Roadless Rule survived a major challenge (Thursday, June 7), when U.S. District Court Judge Clarence Brimmer refused Wyoming’s request to strike it down.

Brimmer — in a ruling cheered by Earthjustice attorney Jim Angell — said his court lacked authority to reinstate his earlier injunction against the Clinton plan. He recommended that Wyoming next approach the 10th District Circuit Court of Appeals.

“The Roadless Rule protects nearly 50 million acres of pristine national forest land that the timber and mining industries would like to exploit for their own private gain, while the American public overwhelmingly wants them protected. Judge Brimmer has ruled that it will remain the law of the land,” said Angell, who argued the case on behalf of various conservation groups.

Angell said it’s likely Wyoming would follow Brimmer’s advice and go to the 10th Circuit Court of Appeals. “It’s not the end of the war,” he said, “But we have won a major victory.”
