NYS Department of Health: Appeal of Constructive Denial of FOIL Request

On February 7, 2020, pursuant to FOIL, Riverkeeper and Earthjustice requested all public comments DOH received in response to its July 2019 proposal to adopt PFAS MCLs. Shortly after sending the FOIL request for public information, DOH asked, and Riverkeeper and Earthjustice agreed, to narrow the scope of the request so that DOH could gather and send the comments more quickly. Almost 6 months later, no records have been received, and DOH has stated it will not respond until late August.

Joint Letter to NYS Senate and Assembly Calls to End Sale of Food Packaging Containing PFAS

In New York State lawmakers are considering bills (S2000B/A4739B) aimed at safeguarding our health from per- or polyfluoroalkyl substances (PFAS). These toxic chemicals found in food packaging may damage the immune system & reduce the effectiveness of vaccines, bringing additional public health concerns during the COVID-19 pandemic. We urge New York State leaders to pass S2000B/A4739B to combat PFAS toxic exposure.

U.S. Moves To Exempt Companies From Reporting Harmful Chemical Releases

Eve Gartner, Managing Attorney, Toxic Exposure & Health Program: “It’s pretty clear that Congress set a 100 pound threshold because they’re concerned about very small amounts of these chemicals being released without people knowing about it. We know that PFAS at 1 teaspoon in an Olympic size swimming pool can have health effects.”
