Complaint: Hawaiian Petrel – Grand Wailea Resort

A coalition of conservation groups filed a second lawsuit to protect Hawaiian petrels (ʻuaʻu) from dangerous lights used by the Grand Wailea Resort on Maui. Hawaiian petrels are protected as an endangered species under the Endangered Species Act. Today’s lawsuit was filed by Earthjustice on behalf of Conservation Council for Hawaiʻi and the Center for Biological Diversity.

60-Day Notice of Intent to Grand Wailea Resort over Violations of the Endangered Species Act

This letter serves as a sixty-day notice, on behalf of the Center for Biological Diversity and Conservation Council for Hawai‘i, of their intent to sue BRE Iconic GWR Owner LLC and Waldorf=Astoria Management LLC over violations of Section 9 of the Endangered Species Act (“ESA”), 16 U.S.C. § 1538, for unpermitted “take” of the endangered Hawaiian petrel (Pterodroma sandwichensis) associated with the Grand Wailea’s operations on the island of Maui.

Notice of Intent: Lawsuit Launched to Stop Hawai‘i’s Airport, Harbor Lights From Killing Rare Seabirds

This letter serves as a sixty-day notice on behalf of Hui Hoʻomalu i Ka ʻĀina, Conservation Council for Hawaiʻi, and the Center for Biological Diversity, of intent to sue the Hawaiʻi Department of Transportation over violations of Section 9 of the Endangered Species Act, 16 U.S.C. § 1538, for unpermitted “take” of threatened Newell’s shearwaters (Puffinus auricularis newelli), endangered Hawaiian petrels (Pterodroma sandwichensis), and Band-rumped Storm petrels (Oceanodrama castro) from the endangered Hawaiʻi distinct population segment associated with HDOT’s airport and harbor facilities on the islands of Kauaʻi, Maui, and Lānaʻi.
