Ajax Claim of Appeal

On behalf of its members, directors, and staff, Flint Rising, the Environmental Transformation Movement of Flint, Michigan United, C.A.U.T.I.O.N., and the St. Francis Prayer Center claims an appeal of the decision of the Michigan Department of Environment, Great Lakes, and Energy (EGLE), on November 15, 2021, to issue Air Permit to Install No. 90-21 (Permit) to Ajax Materials Corporation. The Permit is attached as Exhibit 1 to this Claim of Appeal.

Joint Comments: NYS DEC Implementation of CP-49

As New York State Department of Environmental Conservation (DEC) identifies, “human-induced climate change is the most pressing issue of our time.” The sources that contribute to destabilizing our climate also contribute to the excessive pollution burdens borne by many communities. CP-49 must address the urgency and severity of the climate crisis while also ensuring that pollution disparities affecting disadvantaged communities are addressed at the same time. CP-49 establishes policies for the Department to comply with the Climate Leadership and Community Protection Act (CLCPA).

Joint Comments: NYS DEC Implementation of DAR-21

We urge the New York State Department of Environmental Conservation (DEC) to strengthen DAR-21 so that the state can meet its climate obligations while increasing consideration and protection of disadvantaged communities and other environmental justice communities. Doing so is critical for purposes of DEC’s actions, and because other state agencies — which are equally obligated to consider whether their actions are consistent with Section 7 — will likely look to DEC for guidance.

Title VI Complaint, LDEQ, LDH

Earthjustice and the Lawyers’ Committee for Civil Rights Under Law, on behalf of Concerned Citizens of St. John and the Sierra Club, submitted a complaint to the U.S. Environmental Protection Agency against the Louisiana Department of Environmental Quality and the Louisiana Department of Health for violations of Title VI of the Civil Rights Act. Black residents of St. John the Baptist Parish have been subjected to disproportionate air pollution and extremely high cancer risk caused by various manufacturing facilities, including the Denka neoprene production plant. These agencies have failed to control hazardous air pollution and mitigate its harm.
