The Institute for Fisheries Resources (IFR) and the Pacific Coast Federation of Fishermen’s Associations (PCFFA) filed suit against U.S. tire manufacturers over the use of the chemical 6PPD in rubber tires because of its devastating impacts on Endangered Species Act (ESA)-protected salmon and steelhead.

Earthjustice motion to intervene to defend FERC Order No. 2023

Southwest Power Pool, Midcontinent Independent System Operator, PJM, FirstEnergy, PacifiCorp, and Florida Power & Light want Federal Energy Regulatory Commission (FERC) to gut important provisions of its proposed interconnection rule, Order No. 2023. On November 6, 2023 Earthjustice filed a motion to intervene to defend the FERC rule.

EPA 6PPD Petition Decision

The Environmental Protection Agency (EPA) granted a petition submitted by the Yurok, Port Gamble S’Klallam, and Puyallup Tribes, which asked EPA to develop regulations that prohibit the use of the chemical 6PPD in tires due to the lethal effects of its use for salmon, steelhead trout, and other wildlife.

8th Circuit Chlorpyrifos Decision (Nov 2023)

The 8th Circuit’s decision vacates the Environmental Protection Agency’s (EPA) final rule that revoked all tolerances for chlorpyrifos, thereby banning the use and presence of the neurotoxic pesticide on the foods we eat.

Supplemental comments to Louisiana Department of Natural Resources to deny Venture Global’s coastal use permits to construct and operate a methane gas liquefaction, storage, and export facility that would occupy or affect over 775 acres in Cameron Parish, and to construct 85.4 miles of a 48-inch diameter natural gas pipeline.

Palmer Project: Notice of Appeal

Conservation organizations challenged a controversial wastewater discharge permit for the Palmer Project, a proposed multi-metals mine at the Chilkat Watershed’s headwaters. Earthjustice filed an appeal in Alaska Superior Court on behalf of Lynn Canal Conservation, Rivers Without Borders, and the Southeast Alaska Conservation Council seeking more protective standards for wastewater discharge from mineral exploration conducted by Constantine Metal Resources Ltd (Constantine), a subsidiary of Vancouver, B.C.-based American Pacific Mining.

The States of Washington, Oregon, Vermont, Rhode Island, and Connecticut sent a letter to the EPA voicing strong support for a recent petition from Tribes to the EPA on 6PPD, noting that “6PPD, along with its highly toxic product 6PPD-q, poses an unreasonable threat to the States’ waters and fish resources, and to the continued existence of Northwest salmon and steelhead runs.”

Letter to Gov. Hochul on A.6414/S.6089

The Green Transit, Green Jobs bill (A.6414/S.6089) would require transit agencies to phase in zero emissions buses beginning in 2029 as their buses age out, and fully electric by 2035, while creating community sustaining jobs through the contracting process. Transit buses are among the vehicle classes most primed for electrification now and have a proven track record in a variety of climates and terrains with the potential for good job creation.
