Coal Ash Rule Petition for Review Opinion

These consolidated petitions challenge the Environmental Protection Agency’s 2015 Final Rule governing the disposal of coal combustion residuals (“Coal Residuals”) produced by electric utilities and independent power plants. See Hazardous and Solid Waste Management System; Disposal of Coal Combustion Residuals from Electric Utilities (“Final Rule”), 80 Fed. Reg. 21,302 (April 17, 2015). Coal Residuals make up “one of the largest industrial waste streams generated in the U.S.”

Letter to Council on Environmental Quality urging enforcement, not rewrite, of NEPA

This letter represents the collective response of 341 public interest organizations, representing millions of members and supporters, to the Council on Environmental Quality’s (CEQ) recent Advance Notice of Proposed Rulemaking (ANPRM). Rather than contemplating a rewrite of the National Environmental Policy Act (NEPA) regulations, this letter urges CEQ to invest its modest resources, and most importantly, its leadership position, in a systematic initiative to enforce them.

Legal Document: Court Slams EPA Failure To Protect Children And Farmworkers From Toxic Pesticide

The U.S. Environmental Protection Agency must ban a widely used organophosphate pesticide linked to brain damage in children, the 9th Circuit Court of Appeals ruled. The appellate court ordered EPA to finalize its proposed ban on chlorpyrifos based on undisputed findings that the pesticide is unsafe for public health, and particularly harmful to children and farmworkers.
