Earthjustice Sues to Protect Pacific Islands Heritage Marine National Monument

David Henkin, attorney in Earthjustice’s Mid-Pacific Office, explains our lawsuit.

Earthjustice represented Kāpaʻa, the Conservation Council for Hawai‘i, and the Center for Biological Diversity in a lawsuit that successfully challenged the Trump administration’ decision to permit commercial fishing access within the marine national monument.

After hearing arguments in the case, the federal district court in Honolulu rapidly issued a decision that commercial fishing cannot legally continue in the marine national monument — one of the world’s most pristine tropical marine environments.
