Supreme Court Rejects Builders' Challenge to Pollution Rule
Los Angeles Times : October 3, 2011

  Summary:  The U.S. Supreme Court rejected a case on Monday from homebuilders attempting to overthrow air pollution regulations tied to new development projects. This action upholds the air pollution rule in California’s San Joaquin Valley, which requires homebuilders to offset additional pollution that new development brings.

Earthjustice Attorney Paul Cort, who represented Environmental Defense Fund and Sierra Club, said, “No special interest should have a free ride in a region where schools and parents are frequently warned to keep children indoors on bad air days.”
