Hazardous Waste Combustors Complaint

Earthjustice clients sued the U.S. Environmental Protection Agency to conduct two overdue review rulemakings for hazardous waste combustors standards and to respond to the D.C. Circuit court’s 2008 remand of those standards. EPA never reviewed its standards and while Earthjustice clients hoped to settle with the agency, it did not work out. Earthjustice clients will now file a sur-reply and wait for a court to decide when EPA must set the standards. The agency wants to pass a final rule in 2026, Earthjustice clients want the agency to act sooner.

Petition to remove half of “forever chemicals” in commerce

Earthjustice, on behalf of a coalition of environmental organizations and community advocates, filed a petition with the U.S. Environmental Protection Agency (EPA), urging the agency to revoke the approval and order manufacturers to take off the market 600 PFAS — about half of the PFAS in commerce. EPA approved these toxic “forever chemicals” and allowed them to be sold through illegal use of exemptions in the Toxic Substances Control Act (TSCA).
