Ozone SIPs Notice of Intent

A large coalition of public health, environmental justice, and conservation groups notified EPA of their intent to sue the agency to compel overdue action on state plans that are failing to control ozone pollution—a necessary step on the path to stronger protections from EPA. Earthjustice submitted the notice on behalf of Air Alliance Houston, Downwinders at Risk, Texas Environmental Justice Advocacy Services, Appalachian Mountain Club, Earthworks, Sierra Club, Center for Biological Diversity, Natural Resources Defense Council, and Environmental Defense Fund. Clean Air Task Force, representing Clean Wisconsin, joined the notice.

Comments to DEC in Support of Adopting California’s Truck Emission Standards

Transportation is the largest emitter of greenhouse gas emissions in the United States and in New York. On-road vehicles, especially medium- and heavy-duty vehicles (MHDVs), are also a significant source of toxic pollutants that are harmful to human health. The transportation sector’s detrimental impact on climate, air quality, and health is an urgent crisis that must be addressed immediately. The Empire State must therefore act quickly to create concrete, long-term mechanisms to accelerate transportation electrification. In particular, New York must focus on policies that support zero-emission MHDVs.

Chlorpyrifos Comment Letter (March 2021)

One hundred farmworker, public health, and environmental organizations led by Earthjustice submitted a letter to the Environmental Protection Agency (EPA) urging the Biden administration to ban chlorpyrifos. In December, Trump’s EPA proposed that 11 food uses of the neurotoxic pesticide continue, prolonging harmful exposure to children, farmworkers, and endangered species.

Chlorpyrifos Technical Comments (March 2021)

Earthjustice, on behalf of farmworker, public health, and environmental organizations, submitted comments in response to EPA's proposed interim registration review decision for chlorpyrifos and opens a 60-day public comment period on the proposed interim decision, revised draft human health risk assessment and ecological risk assessment for chlorpyrifos. EPA is conducting its registration review of chlorpyrifos pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) that requires that the registrations of pesticides are to be reviewed every 15 years.

MREA Petition and Complaint for Declaratory Judgement and Injunction

The Midwest Renewable Energy Association filed a lawsuit in Wisconsin Circuit Court to remove barriers preventing Wisconsinites from accessing the benefits of local clean energy development. MREA’s filing asks the court to ensure that the Public Service Commission of Wisconsin sticks to regulating monopoly utility companies and does not illegally interfere with competitive clean energy alternatives for Wisconsin families and businesses.

Fourteen health and environmental groups, half of them represented by Earthjustice, challenged ozone standards in a lawsuit in a federal appeals court. The move comes in response to the Environmental Protection Agency (EPA) and Trump administration’s last-minute refusal to strengthen the National Ambient Air Quality Standards, or NAAQS, for ozone, and less than a month after Earthjustice sued the EPA over a similar rule affecting particulate matter.
